Terms of Service

The rules and guidelines for using our fantasy sports platform

1. Acceptance of Terms

By accessing or using the Fantasy Sports Australia platform, including our website, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Fantasy Sports Australia Pty Ltd ("we", "our", or "us") reserves the right to modify these Terms at any time. We will provide notice of any material changes through the Service or by other means. Your continued use of the Service after such notice constitutes your acceptance of the modified Terms.

2. Eligibility

You must be at least 18 years old to access or use our Service. By accessing or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

The Service is intended for users located in Australia. You are responsible for complying with all local laws applicable to your use of the Service.

3. Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update such information as necessary.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to disable your account at any time, including if we believe that you have violated these Terms.

4. Fantasy Competitions

4.1 Rules and Scoring

Each fantasy competition has specific rules, scoring systems, and eligibility requirements. You are responsible for reviewing and understanding the rules of each competition before participating.

We reserve the right to modify competition rules, scoring systems, and prize structures at any time. We will make reasonable efforts to notify users of significant changes.

4.2 Entry Fees and Prizes

Some competitions require entry fees. All entry fees must be paid in full before participating in a competition. Entry fees are non-refundable except as expressly provided in these Terms or required by law.

Prize amounts and distributions are as specified in the competition rules. We reserve the right to cancel any competition if there are insufficient entries. In such cases, entry fees will be refunded.

All prizes are awarded "as is" without warranty of any kind, express or implied. Winners are responsible for all taxes and fees associated with prize receipt and/or use.

4.3 Fair Play

You agree to participate in competitions fairly and in compliance with all applicable rules. Prohibited conduct includes, but is not limited to:

  • Using multiple accounts to enter the same competition
  • Colluding with other users to gain an unfair advantage
  • Using automated scripts, bots, or other software to manage teams
  • Exploiting bugs or errors in the Service
  • Engaging in any activity that violates the integrity of the competitions

We reserve the right to disqualify users, void entries, and withhold prizes if we suspect or determine that a user has engaged in prohibited conduct.

5. Payments and Withdrawals

5.1 Deposits

You may deposit funds into your account using the payment methods we make available. You represent and warrant that you are authorized to use any payment method you provide.

We may impose minimum and maximum deposit amounts. Deposits may be subject to processing fees, which will be disclosed at the time of transaction.

5.2 Withdrawals

You may withdraw available funds from your account subject to our verification procedures. Withdrawals may be subject to processing fees and minimum withdrawal amounts.

We reserve the right to delay or refuse withdrawals if we suspect fraudulent activity or violations of these Terms.

6. Intellectual Property

The Service and its content, features, and functionality are owned by Fantasy Sports Australia and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

7. User Content

You retain ownership of any content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with providing and promoting the Service.

You represent and warrant that your User Content does not violate any third-party rights and complies with these Terms and all applicable laws.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Harass, abuse, or harm another person
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity

  • Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks connected to the Service
  • Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL FANTASY SPORTS AUSTRALIA OR ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fantasy Sports Australia and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without giving effect to any choice or conflict of law provision or rule.

13. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in Melbourne, Victoria, in accordance with the rules of the Australian Centre for International Commercial Arbitration.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
